1. Concepts
1.1 CV.lt is a portal managed and administered by (registration address: Ozo g. 12a, Vilnius, LT-08200, company code: 302581055, VAT code: LT100005921818, email: [email protected]).
1.2 Person – a person who has created a personal profile on the portal CV.lt with the aim of using the services provided by the CV.lt.
1.3 CV.lt Customer – a natural or legal person purchasing the services of searching for employees online and using the database and / or selecting employees CV.lt.
1.4 Terms of Use – the terms that shall regulate the use of CV.lt’s website and services.
2. Application of the Terms of Use
2.1 These Terms of Use constitute an agreement between the Person and CV.lt that after creating his personal account CV.lt, the Person, at his own discretion, records and stores in CV.lt databases the data of his CV and CV.lt uses this data to search for suitable candidates for CV.lt’s Customers.
2.2 CV.lt provides only technical means for placing information, the work is offered by CV.lt Customers. CV.lt does not undertake to employ the Person, constantly send him offers or exclusively offer him CV.lt Customers.
3. Obligations and rights of a person
3.1 The person is responsible for not disclosing the account login data created by him/her to third parties.
3.2 The Person is responsible for the correctness of the data provided in his CV.
3.3 The Person who has entered CV.lt his/her curriculum vitae determines for himself/herself the possibilities of his/her display CV.lt to the Customers, which the CV.lt is guided by when providing services to Customers.
3.4 By registering his personal account CV.lt, the Person does not acquire the rights to the ownership of the CV.lt database.
3.5 The Person has all the rights to his personal data stored in CV.lt databases, as established by the current legislation. The Person has the opportunity to edit, supplement, delete his data at any time, as well as make them inaccessible to CV.lt Customers by selecting the appropriate status of his/her CV.
4. CV.lt obligations and rights
4.1 CV.lt has the right to collect, store, edit, process personal and other data recorded by the Person and transfer them when providing services to CV.lt’s Customers. CV.lt performs the actions of storage, management and processing of personal data in accordance with all applicable legal acts. CV.lt primarily processes the data for the performance of the Agreement concluded with the Person, the object of which is to intermediate the Person’s CV to CV.lt’s Customers and to enable the Person to apply for job offers.
4.2 Data collected and processed by CV.lt may include the Person’s name, date of birth, personal identification code, e-mail address, telephone, home address, any other data describing the Person and his career, and all other data related to the use of CV.lt’s website and Services.
4.3 In cases where the Person may impose restrictions on the use of data in his account (options for displaying a resume, blocking certain employers without showing them a Person's resume, and restrictions of a similar nature), CV.lt use those data only within the limits set by the Person.
4.4 If the Person submits their CV to apply for a particular job offer, all data contained in the CV shall be transferred to the particular CV.lt Customer regardless of the CV disclosure level.
4.5 CV.lt has the right to delete non-conforming or improperly filled out CVs of Persons. CV.lt also has the right to delete the CV due to improper actions of the Person CV.lt, CV.lt in relation to the Customers, or other Persons who cause moral or material damage.
4.6 The data provided by the person may be verified by CV.lt consultants before being shown to CV.lt Customers.
4.7 CV.lt shall not be liable for damages arising from the actions, promises or other conduct of the CV.lt Customers related to employment. CV.lt in contracts with CV.lt Customers regarding the provision of services CV.lt, the Customers undertake to process personal data in accordance with all applicable legal acts and all responsibility for non-compliance with these requirements lies with the CV.lt the Customers.
4.8 CV.lt has the right to notify the Person about the services of CV.lt and its partners, the opportunities offered and related news to the e-mail address provided by the Person.
4.9 CV.lt has the right to use the Person's contact details to inform him about potentially suitable job offers, CV.lt system’s material changes or changes in the Terms of Use of this Agreement.
4.10 If the Person CV.lt provides his/her contact and identification data, his/her curriculum vitae, cover letter, applying according to the ad placed on the CV.lt, but does not have access to his/her account CV.lt (because he has not confirmed the authenticity of his/her data, has not created a password), the Person agrees that the CV.lt processes and transfers the data provided by the Person to the CV.lt the Client, who CV.lt placed a job ad with the job ad, for which the Person provided his/her data, and the respective CV.lt the Data provided by the Client would be used by the Client for the purpose of selecting and recruiting employees. The legal basis for the processing of personal data is the legitimate interest of the CV.lt the Client to assess the person's suitability to perform the desired job. The Client will store personal data CV.lt for no more than 4 months from the end of the selection to the workplace published in the advertisement.
4.11 CV.lt shall process personal data in accordance with applicable legislation, including, but not limited to, Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
4.12 CV.lt reserves the right to store the Person’s personal data to the extent necessary for the purposes outlined in the Privacy Policy. The Person’s personal data will be retained for as long as required to fulfill these purposes, and as allowed by applicable legislation. By accepting these Terms of Use, the Persons consent to the collection, storage, and processing of their personal data in accordance with the Privacy Policy and applicable legislation
5. Liability of the parties
5.1 The Parties undertake to properly perform all of their obligations under these Terms of Use and to refrain from any action that could cause harm to each other.
5.2 The Person guarantees and assumes full responsibility for the fact that by providing his data, he does not violate any applicable legal norms and any rights of third parties. If any third party makes CV.lt claims or a claim for violation of his rights related to the Person's activities, then CV.lt will inform the Person who undertakes to settle claims or take other actions that would prevent the CV.lt from suffering damages and / or losses.
5.3 CV.lt shall not be liable for the reliability of the database information, including but not limited to its correctness, accuracy and errors, as well as for any damage suffered by the Person as a result of the use of the data contained in the database.
6. Transferability
6.1 CV.lt reserves the right to transfer, delegate or assign any of its right or obligations stipulated in these Terms of Use without the Person’s consent, including but not limited to in connection with a merger, acquisition, change of ownership or the sale of assets. Such transfers shall be limited to intra-European Union (EU) scenarios and to jurisdictions subject to the provisions of the General Data Protection Regulation (GDPR), including countries deemed adequate by the European Commission.
6.2 In the event of a merger, acquisition or any change of ownership, CV.lt will make a reasonable effort to notify all Persons via the provided contact details. Parties acknowledge that such notifications may be subject to a delay or failure due to technical or operational reasons.
6.3 Following any such merger, acquisition or change of ownership, the Terms of Use will remain valid and binding upon all parties. All rights and obligations stipulated in these Terms of Use shall persist despite any possible changes in ownership.
6.4 By agreeing to these Terms of Use, the Person acknowledges the transfer of their personal data and other data, as outlined in the Privacy Policy, in the event of any merger, acquisition or change of ownership.
6.5 Persons retain the right to terminate their account and discontinue their use of CV.lt’s services should they not agree to the transfer of their data and rights under these Terms of Use.
7. Applicability of the Agreement
7.1 The Terms of Use of this Agreement shall enter into force after the Person registers a personal account CV.lt and shall remain in force until the Person terminates his/her CV.lt account.
7.2 Any changes in the Terms of Use of this Agreement shall become effective immediately upon their publication on CV.lt’s website.
7.3 In the case the Person disagrees with the changes in the terms, the Person reserves the right to terminate their agreement with CV.lt within 15 (fifteen) days as from the publication of the changed terms by sending respective written notice. In the case the Person fails to terminate their agreement within the term specified in this clause or the Person begins to use CV.lt’s services or website before the elapse of the term, the Person is considered to have read and accepted the changes in the terms of this agreement.
7.4 In the event of any conflict or inconsistency between these Terms of Use and any other associated documents, including but not limited to the Privacy Policy, Cookie Policy, or any supplemental agreements, these Terms of Use shall prevail to the fullest extent permitted by applicable legislation.
8. Dispute resolution
8.1 In order to express their disapproval or claims CV.lt, the Person must contact us by e-mail [email protected].
8.2 Disputes between the CV.lt and the Person shall be settled by a benevolent agreement. In case no settlement is reached, the dispute shall be settled in the Court of Vilnius, the Republic of Lithuania.
